FoxHire, an Employer of Record platform on Human Cloud, just released their Multi-State Hiring Compliance Burden Index. AP News, MarketWatch, Business Insider, and Yahoo Finance all picked it up.

The data is staggering. And it tells a story that every workforce leader needs to hear.

The Numbers

FoxHire surveyed 1,000 HR, payroll, staffing, and business professionals. Here's what they found:

  • 50% of employers have rejected qualified candidates because of state compliance concerns
  • 48% delayed hiring or expansion due to regulatory uncertainty
  • 79.9% experienced adverse hiring outcomes due to state compliance rules
  • 43.7% quietly decided not to hire in specific states without even informing candidates
  • 25% paid penalties, interest, or fines in the past 24 months

Read that again: half of employers are turning away people they want to hire. Not because of skills. Not because of culture fit. Because of paperwork.

The State-by-State Reality

California (36.4%) and New York (32.8%) top the burden rankings. New Jersey, Illinois, and Pennsylvania round out the top five.

Now compare that to Bureau of Labor Statistics employment growth data from 2019 to 2024:

  • California: 3.0% growth
  • New York: 0.8% growth
  • Texas: 10.3% growth
  • Tennessee: 8.1% growth

The correlation is hard to ignore. The states with the heaviest compliance burden are seeing the slowest job growth. The states where it's easier to hire are growing three to ten times faster.

The Hidden Cost Nobody Talks About

The most alarming stat in FoxHire's index is the 43.7% of employers who quietly avoid hiring in certain states altogether. No rejection letter. No explanation. Just silence.

That means nearly half of U.S. employers have a secret blacklist of states they won't touch. Qualified candidates in those states never even get considered. Companies in those states lose access to flexible talent they desperately need.

And only 17% of employers maintain dedicated external compliance support. The rest are relying on payroll software (42%) or winging it internally. That is how you end up with a quarter of companies paying fines.
